FSSAI Enforces Single Use Plastic Ban

FSSAI enforces single-use plastic ban through it’s latest order of 16th June 2023.

FSSAI has advised the food safety officers and DO of all regions to ensure the enforcement of Plastic Waste Management Rules, 2016 and its amendments. It has also advised that the usage of single-use plastics which have low utility and high littering potential is prohibited. The concerned FBOs shall also be made aware of the same to ensure self-compliance.

Let us understand in detail what is single use plastic, what are the rules and what is the penalty?

What is single-use plastic?

‘Single-use plastic’ are those that are discarded or disposed of after one single use.

What kinds of single-use plastic items are prohibited?

Single-use plastic items such as candy sticks, plastic sticks, plates, cups, glasses, cutlery such as forks, spoons, knives, straws, trays, wrappings or packing films around sweet boxes, invitation cards and cigarette packets, plastics or PVC banners less than 100 micron and stirrers which have low utility and high littering potential.

This ban just not prohibits the usage of single use plastic but also the manufacturing, import, stocking, distribution and sale as well.

What is the date of enforcement on the prohibition single-use plastic?

The ban on single use plastic came in effect from 1st July, 2022.

What is the penalty for violating the ban on the single-use plastic?

The penalty for violating the ban is as per provisions of the Environment Protection Act, 1986. “This can be a fine of up to Rs. 1 lakh or up to five years imprisonment”.

But, the quantum of penalty will depend upon the local civic bodies taking punitive actions including fines or jail actions.

Why FSSAI is conducting special enforcement drive on the use of single-use plastic?

FSSAI has advised the Food Safety Officers and DO of all regions to ensure the enforcement on the ban of single use plastic specially used as packing films around the sweet boxes.

Conclusion

Ban on the usage of single-use plastic is a necessity of the present time from environmental and waste management perspectives.
Different authorities from time to time try to curb this menace with impactful enforcements but this alone is not the responsibility of governing authorities but as responsible citizens and consumers, we also have to play our part.
