Through a notification dated 21 July 2020 the FSSAI has made public that the Food Safety and Standards (Prohibition and Restrictions on sales) First Amendment regulations related to the sale of beverages containing artificial sweeteners through vending machines have been Gazette Notified.
The draft of the Food Safety and Standards (Prohibition and Restrictions on Sales) Amendment Regulations, 2018, was published vide notification of the FSSAI on 26th November 2018, in the Gazette of India. After which the FSSAI had invited objections and suggestions from persons likely to be affected thereby, within a period of thirty days from the date on which the copies of the Official Gazette, containing the said notification were made available to the public on the 29th November 2018.
After taking into consideration the objections and suggestions received from the public in respect of the said draft regulations, the FSSAI has made regulations further to amend the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011.
These regulations may be called the Food Safety and Standards (Prohibition and Restrictions on Sales) First Amendment Regulations, 2020. They shall come into force on the date of their publication in the Official Gazette.
In the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011, in regulation 2.3 Prohibition and Restriction on sale of certain products in sub-regulation 2.3.14: Restrictions relating to conditions for sale in clause (19), the following proviso has been added to the existing regulation.
“Provided that if such product is sold through a vending machine, the food business operator shall display on the vending machine prominently and cause it to be labelled on the cup or container in which the product is served in respect of artificial sweetener as per the labelling requirements specified under regulation 2.4.4 (24, 25, 26, 28 and 29) of Food Safety and Standards (Packaging and Labelling) Regulations, 2011.
